Terms of Service

1. Acceptance of Terms

By creating an account, booking a session, or using the Vetted platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Eligibility & Accounts

• 18+ Requirement: You must be at least 18 years old to create an account and purchase sessions.
• Authorized Use for Minors: If you are booking a session for a minor (under 18), you represent that you are the legal parent or guardian of that minor and you consent to the session under the strict supervision rules outlined in Section 4.

3. No Guarantee of Results (The "Scholarship" Disclaimer)

VETTED IS A MENTORSHIP PLATFORM, NOT A RECRUITMENT AGENCY. You acknowledge and agree that Vetted and the Mentors (Pros/Athletes) make NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES regarding specific outcomes, including but not limited to:

• Securing a university scholarship or financial aid.
• Signing a professional contract or academy placement.
• Specific athletic performance improvements (e.g., running a specific time, jumping a specific height).
• Selection for any specific team, club, or organization.

Any advice given by a Mentor is based on their personal experience and opinion. Vetted is not liable for any failure to achieve specific athletic or career goals.

4. Safety & Conduct (The "Parent in the Room" Rule)

The safety of minors is our absolute priority.

• Physical Presence: For any session involving a participant under the age of 18, a parent or legal guardian MUST be physically present in the same room for the entire duration of the video call.
• Camera Visibility: The parent/guardian must acknowledge their presence on camera at the start of the session.
• Termination for Non-Compliance: If a Mentor determines that a minor is unsupervised, they reserve the right to terminate the session immediately. In such cases, NO REFUND will be issued.
• Prohibited Conduct: Any harassment, inappropriate language, or nudity will result in an immediate permanent ban and reporting to local authorities if necessary.

5. Scope of Services

• No Agency Relationship: Mentors are independent contractors providing technical analysis and mentorship. They are not acting as agents, scouts, or representatives of any professional team or university.
• No Introductions: The purchase of a session does not entitle the User to personal introductions, networking contacts, or referrals to the Mentor's former coaches, agents, or teams.

6. Limitation of Liability (The "Anti-Sue" Clause)

TO THE FULLEST EXTENT PERMITTED BY LAW, VETTED AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. IN NO EVENT SHALL VETTED'S AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO VETTED IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

7. Video Recording

You acknowledge that sessions take place via third-party video providers (e.g., Daily.co). Vetted records these sessions for safety, quality assurance, and dispute resolution. By participating, you consent to being recorded.

8. Cancellations, Refunds & "All Sales Final" Policy

8.1. All Sales Are Final

By booking a session on Vetted, you acknowledge that you are purchasing a specific, reserved time slot on a professional athlete's calendar. ALL SALES ARE FINAL. Vetted does not offer refunds, credits, or exchanges for User cancellations, scheduling conflicts, or "No-Shows," regardless of the notice period provided.

8.2. The "Opportunity Cost" Agreement

You acknowledge that the Mentor's time is a limited commodity. Once a slot is booked, it is removed from the marketplace and cannot be sold to another user. Therefore, your payment is for the reservation of the time, not solely the attendance of the event.

8.3. Chargeback & Dispute Waiver

By agreeing to these Terms, you agree not to initiate a chargeback or dispute with your credit card issuer for any "All Sales Final" transaction.

• You expressly agree that a "No-Show" or failure to attend the session by the User does not constitute a "Product Not Received" or "Service Not Delivered" claim.
• Vetted reserves the right to present this Agreement as compelling evidence to your bank to contest any such dispute.

8.4. Mentor Cancellations (The Only Exception)

In the event the Mentor (Athlete) fails to attend or cancels the session, you are entitled to a full 100% refund.

9. Intellectual Property & Content Usage

9.1. Ownership of Recordings

You acknowledge and agree that Vetted owns all rights, title, and interest in and to any video recordings, audio, or transcripts generated during the Session ("Session Content").

• The Mentor (Pro) retains their own Name, Image, and Likeness rights.
• The User (You) obtains a limited, non-exclusive, non-transferable license to view the Session Content solely for private, personal, and educational purposes.

9.2. Strict "No Social Media" & "No Public Sharing" Policy

Unless explicitly authorized in writing by Vetted, You are strictly prohibited from:

• Posting, uploading, or streaming any portion of the Session Content on public platforms, including but not limited to Instagram, TikTok, YouTube, X (Twitter), Facebook, or LinkedIn.
• Screen Recording: Using external software or devices to record, capture, or rip the video stream during a live session.
• Commercial Use: Using the Session Content to market, promote, or endorse any player, product, service, or agency. (e.g., You cannot use a clip of a Mentor to promote a recruiting profile).

9.3. Violation & Takedowns

• Immediate Ban: Any violation of this policy will result in the immediate termination of your account without refund.
• DMCA & Takedowns: You agree that Vetted has the right to issue DMCA Takedown Notices to any third-party platform (e.g., Instagram) to remove unauthorized content. You waive any right to dispute such takedowns.
• Legal Action: Vetted and the Mentor reserve the right to pursue legal action for damages regarding unauthorized use of Name, Image, and Likeness (NIL) or copyright infringement.

10. Fees, Payments, and Revenue Share

10.1. Refunds & Disputes

In the event of a dispute where a someone requests a refund due to a Mentor's failure to attend a session or deliver a review, Vetted reserves the right to withhold or reverse the Payout for that specific transaction.

11. Jurisdiction

These terms shall be governed by the laws of England.
